We have considerable experience in assessing potential negligence claims against accountants, auditors and tax advisers.
Our expert has over 30 years of experience in practice advising clients and is therefore able to provide an independent opinion on whether the accountant has undertaken the work at the standard of a reasonably competent professional.
In addition to assessing whether the accountant has been negligent we will also give an opinion on the financial loss arising from the negligence.
Typically in professional negligence matters we are instructed by either the claimant or defendant and act as Party Expert. We have undertaken a similar number of instructions on behalf of claimants as those accepted for defendants. Previous engagements have included cases of negligence in giving tax advice or tax compliance such as in respect of:
• Capital allowances
• Film tax schemes
• Research & development claims
• Entrepreneurs' relief
• Employee benefit trusts
• Remuneration trusts
• Partnership tax schemes
• Failure to file elections or claims
In respect of claims against other professionals including architects, lawyers, doctors, we can assist in providing an estimate of the financial loss arising from the professional negligence.
In matters of alleged professional negligence by accountants, auditors and tax advisers we can provide a preliminary view on whether the professional has been negligent and an estimate of the financial loss. This can assist an early resolution through mediation or arbitration.
We can assist in fraud investigations and in the detection and prevention of financial crime.
We can undertake an investigation into accounting irregularities and financial misstatements. We undertake regulatory investigations and investigations linked to contentious insolvency.
We investigate concerns relating to employee, director or officer fraud. We provide an independent view on the alleged fraud and the quantum of misappropriation of funds. If necessary, we can provide court compliant reports.
Following a fraud investigation, we can provide reports to management, regulatory bodies or court compliant reports to assist in litigation.
We advise organisations on preventing and detecting fraud. We can undertake internal audit checks and provide recommendations to assist in fraud detection and prevention.
Contentious insolvency normally stems from fraud or wrongful trading. As forensic accountants we can investigate the financial records and unpick the accounting transactions to provide an opinion on the actions of the company directors and possibly other advisers.
